It is important to read these Terms of Service prior to each purchase so you will understand the terms applicable to such transactions. If you do not agree to these Terms of Service, do not make any purchases.

In these Terms of Service we refer to the following parties:

 

Subscriber, “you”/your”: regarding the person who purchased a subscription at stream.juulvanderlaan.nl

 

Service, “we/our/us”: regarding stream.juulvanderlaan.nl, and studio thnkthnk as the entity that provides it.

 

Content: Audiovisual materials such as films, trailers, clips and stills.

 

Subscription cycle: the time between first payment for a subscription (weekly or yearly), up until the moment of cancellation.

 

Educational settings: primary, secondary or tertiary educational institutes or not-for-profit educational organisations. Private companies in any way, shape or form are not deemed an educational setting under these terms of service.

 

1. Subscription

1.1 Age

 

By purchasing a subscription and becoming a subscriber, you represent that you are at least 16 years of age. If you are younger, you require the permission of a parent or guardian to purchase a subscription, and use the Service. 

1.2 Access

 

1.2.1 Upon subscription you will receive a confirmation mail with access link in the inbox of the e-mail address you provided during payment. With this link you can access your personal subscription page featuring our Content. This content can be watched on a maximum of 5 different devices, for an unlimited amount of times during the subscription period.

 

1.2.2 The quality of the display of the content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection.

1.3 Prices and transactions

1.3.1 Prices on stream.juulvanderlaan.nl are published in euros and include VAT, which rate is based on that of the country from which you purchase a subscription.

 

1.3.2 Your subscription, depending on the one you choose, will continue week to week or year to year unless and until you cancel your subscription. We will bill the subscription fee to your payment method. You must cancel your subscription before it renews in order to avoid billing of the next period's subscription fees to your payment method.

 

1.3.3 By starting your subscription, you authorise us to charge you a weekly or an annual subscription fee, depending on your choice of subscription, at the then-current rate to your payment method.

 

1.3.4 The subscription fee for our service will be billed at the beginning of the paying portion of your subscription unless and until you cancel your subscription. We automatically charge your payment method weekly or annually, depending on your subscription choice, on the calendar day corresponding to the commencement of your subscription. Subscription fees are fully earned upon payment. We reserve the right to change the timing of our billing, in particular, as indicated below, if your payment method has not successfully settled. In the event your subscription begins on a day not contained in a given month, we may bill your payment method on a day in the applicable month or such other day as we deem appropriate. For example, if your next payment date is likely to be February 28th, and your payment method would be billed on that date. Your renewal date may change due to changes in your subscription.

 

1.3.5 If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your payment method information or cancel your account, you remain responsible for any uncollected amounts and authorise us to continue billing the payment method, as it may be updated. This may result in a change to your payment billing dates. For certain payment methods, the issuer of your payment method may charge you a foreign transaction fee or other charges. Check with your payment method service provider for details.

 

1.3.6 We may cancel your subscription immediately if no payment occurs via your chosen payment method, or if an already paid amount is returned to your account.

 

1.3.7 We reserve the right to adjust pricing for our service or any components thereof at any time, for subscribers this counts up until a first payment has taken place for a subscription cycle.

1.4 No refunds

 

For the purchase of a subscription to our streamable digital content there is no cancellation period. This means that payments are nonrefundable and there are no refunds or credits for partially used periods.

1.5 Cancellation

 

1.5.1 You may cancel your subscription at any time. Beware that upon cancellation access to content is immediately revoked. (This is due to technical limitations we hope to see resolved in the future.) We do not provide refunds or credits for any partial subscription periods. To cancel, go to the confirmation mail of your subscription and follow the link to your invoice. It will take you to the Purchase info page which contains a cancellation button. If you cancel, your subscription will immediately terminate, and you will lose access to the Content. So please make sure to cancel after you are done watching, as no refunds will be paid out in case of early cancellation.

 

1.5.2 We may cancel your subscription immediately and without notice, should you be in breach of the conditions as described in these Terms of Service, or if we have a strong suspicion that you are.

2. License

2.1 Regular subscriptions

During your subscription we grant you a limited, non-exclusive, non-transferable right to access the service and view Juul van der Laan’s Content. Except for the foregoing, no right, title or interest shall be transferred to you. And in no case you are allowed to sub-license any of the content. You agree to use the service only within your personal, domestic setting, and in no way screen, or facilitate the screening of, the Content in public.

2.2 Educational licenses

During your subscription for an Educational license we grant you a limited, non-exclusive, non-transferable right to access the service and view Juul van der Laan’s Content. Except for the foregoing, no right, title or interest shall be transferred to you. And in no case you are allowed to sub-license any of the content. You may use the service for public screenings in a physical educational setting, of which the territory licensed is limited only to the country of purchase. It is specifically not allowed to publically publish and share the Content online. Educational settings are defined as in-house screenings in primary, secondary or tertiary educational institutes or at not-for-profit educational organisations. Private companies in any way, shape or form are not eligible for an Educational license, and would require a commercial license. This Educational license immediately loses its validity when above defined Educational setting (intends to) charge ticket prices for the screening of the Content, in which case a commercial license will be required. 2.3 Commercial licensing

 

Commercial or promotional use of the content is strictly not allowed under any of the licenses publically provided on this website. 2.4 Content changes

 

We reserve the right to change (parts of) our Content at any time, and we cannot be held liable for exercising this right. We will make an effort to notify subscribers of changes when they occur, inasmuch as possible.

 

3. Intellectual property

3.1 All rights reserved

All materials on the Website, including but not limited to images, trailers, clips, the Content, and texts are legally owned by Juul van der Laan and protected by Dutch law under, but not limited to, intellectual property legislation. You may not use these protected materials in any other way than strictly stated in these Terms of Service. The Content will at all times remain the property of Juul van der Laan.

3.2 Forbidden activity

3.2.1 You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorised in these Terms of Service) content and information contained on or obtained from or through the service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the service; use any robot, spider, scraper or other automated means to access the service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the service; insert any code or product or manipulate the content of the service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of the service if you violate these Terms of Service or are engaged in illegal or fraudulent use of the service.

 

3.2.3 You agree not to act in conflict with current Dutch law, among which, but not limited to, those laws regarding intellectual property. When you act in conflict with these conditions (as stated in article 3 of these Terms of Service), especially in case of making Content public, reproduction, making Content accessible to third parties, and/or distribution of the Content, we will report to the police and charge all costs and damages, among which, but not limited to immaterial and material damages to you. In this case you will also be excluded from ever using our Service henceforth.

5. Privacy

For this service we make use of third parties, such as payment service Stripe Ltd. and e-commerce platform UAB Sellfy. Please see our Privacy Policy to learn more about how we use your data to be able to show you our Content.

6. Indemnity by you

You agree to indemnify and hold us, studio thnkthnk and Juul van der Laan, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney’s fees, arising out of or in connection with your purchase or use of any product or services, or any violation of this Agreement or of any law or the rights of any third party.

7. Limitations on Liability

7.1 We don’t give any guarantees nor accept any liability regarding the accessibility or quality of the Content in case of insufficient functionality of your devices or internet connection.

 

7.2 We are not liable for any shortcomings of third-parties we use for delivering the Content to you, such as our payment service Stripe Ltd. or the hosting platform UAB Sellfy.

 

7.3 We do not accept any liability in case Content does not live up to your expectations.

 

7.4 We reserve the right to cancel the Service or change the platform-, payment- or any other provider that enables us to offer our services at any time, and we cannot be held liable for exercising this right. In the case that this directly affects your access to the Content, we will notify you of this change in advance, and give you, if relevant, the option to cancel and/or change your subscription. For such cases as mentioned in this paragraph, please review article 7.5 of these Terms of Service to resolve any issues that may arise.

 

7.5 Notwithstanding the mentions in this article, should you have a complaint or question, you can send a message regarding the matter to notify us as soon as possible, using the following mail address: stream@juulvanderlaan.nl. No matter the grounds, should we be held liable for any other damages, then these damages will always be limited to no more than the amount we have received from you for providing the subscription service during the period in question.

8. Force majeure

In case of force majeure, which means any shortcoming which cannot be attributed to us because we are not at fault, or there is no way we could have foreseen or prevented it from happening, we can cancel your subscription(s) without any judicial involvement, and without being held liable.

9. General

 

9.1 These Terms of Service contain the entire understanding and agreement between us and you in relation to your use of the service and supersedes and replaces any representation, statement or other communication (whether written or otherwise) made by you or us which is not contained herein.

 

9.2 By using the Service and proceeding with payment, the Subscriber accepts these Terms of Service.

 

9.3 We reserve the right to change these Terms of Service without notifying you. The most recent version of these terms can be found on stream.juulvanderlaan.nl.

 

9.4 Should any part of these Terms for any reason be declared invalid or unenforceable by a court of a competent jurisdiction, it shall be deemed to be deleted without affecting the remaining provisions.

 

9.5 These Terms are governed and construed in accordance with the laws of The Netherlands, and you consent to the exclusive jurisdiction of the courts of The Netherlands.
